                  Patent Cooperation Treaty (PCT) Information

   For information concerning PCT member countries, see the notice
appearing in the Official Gazette at 1382 O.G. 61, on September 11, 2012.

   For information on subject matter under Rule 39 that a particular
International Searching Authority will not search, see Annex D of the PCT
Applicants' Guide.

European Patent Office as Searching and Examining Authority

   The European Patent Office (EPO) may act as the International Searching
Authority (ISA) or the International Preliminary Examining Authority (IPEA)
for an international application filed with the United States Receiving
Office or the International Bureau (IB) as Receiving Office where at least
one of the applicants is either a national or resident of the United States
of America. However, the use of the EPO is restricted. The EPO will not act
as an ISA for applications with one or more claims directed to a business
method. For the definition of what the EPO considers to be precluded
subject matter in the field of business methods, see PCT Applicants's
Guide, Annexes D(EP), E(EP) and the Official Notices (PCT Gazette) dated
May 6, 2010, page 94
(http://www.wipo.int/pct/en/official_notices/index.html). The EPO will act
as an IPEA only if it also acted as the ISA.

   The search fee of the European Patent Office was increased, effective
April 1, 2012, and was announced in the Official Gazette at 1377 O.G. 5, on
April 3, 2012.

Korean Intellectual Property Office as Searching and Examining Authority

The Korean Intellectual Property Office may act as the ISA or the IPEA for
an international application filed with the United States Receiving Office
or the International Bureau (IB) as Receiving Office where at least one of
the applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1302 O.G.
1261 on January 17, 2006.

   The search fee of the Korean Intellectual Property Office was decreased,
effective January 1, 2012, and was announced in the Official Gazette at
1373 O.G. 177, on December 27, 2011.

Australian Patent Office as Searching and Examining Authority

   The Australian Patent Office (IP Australia) may act as the ISA or the
IPEA for an international application filed with the United States
Receiving Office or the International Bureau (IB) as Receiving Office where
at least one of the applicants is either a national or resident of the
United States of America. The announcement appears in the Offical Gazette
at 1337 O.G. 265, on December 23, 2008. However, the use of IP Australia is
restricted. IP Australia will not act as an ISA for applications with one
or more claims directed to the fields of business methods or mechanical
engineering or analogous fields of technology as defined by specified areas
of the International Patent Classification System, as indicated in the
Official Gazette at 1337 O.G. 261 on December 23, 2008, in Annex A to the
agreement between the USPTO and IP Australia, IP Australia will act as an
IPEA only if it also acted as the ISA.

   The search fee of IP Australia was increased, effective July 1, 2012,
and was announced in the Official Gazette at 1380 O.G. 5, on July 3, 2012.

The Federal Service on Intellectual Property, Patents & Trademarks of
Russia as Searching and Examining Authority

   The Federal Service on Intellectual Property, Patents & Trademarks of

Russia (Rospatent) may act as the ISA or the IPEA for an international
application filed with the United States Receiving Office or the
International Bureau (IB) as Receiving Office where at least one of the
applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1378 O.G. 162,
on May 8, 2012.

   The search fee of Rospatent was decreased, effective August 22, 2012,
and was announced in the Official Gazette at 1383 O.G. 179, on October 9,
2012.

Fees

   The transmittal fee for the USPTO was changed to include a basic portion
and a non-electronic filing fee portion, effective November 15, 2011, and
was announced in the Federal Register on November 15, 2011. Search fees for
the USPTO were changed, effective January 12, 2009, and were announced in
the Federal Register on November 12, 2008. The fee for filing a request for
the restoration of the right of priority was established, effective
November 9, 2007, and was announced in the Federal Register on September
10, 2007.

   International filing fees were decreased, effective November 1, 2012,
and were announced in the Official Gazette at 1383 O.G. 179, on October
9, 2012.

   The schedule of PCT fees (in U.S. dollars), as of November 1, 2012, is

                   Notice of Maintenance Fees Payable

   Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.

   Attention is drawn to the patents that were issued on December 22, 2009
for which maintenance fees due at 3 years and six months may now be paid

   35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required
maintenance fee and any applicable surcharge are not paid in a patent
requiring such payment, the patent will expire at the end of the 4th, 8th
or 12th anniversary of the grant of the patent depending on the first
maintenance fee which was not paid.

                              Notice of Exclusion

   This notice concerns Stephen R. Greiner of Bethesda, Maryland, a
registered patent attorney whose registration number is 36,817. In a
disciplinary proceeding, Mr. Greiner has been excluded from practice of
patent, trademark, and other non-patent law before the Office. The Director
of the Office of Enrollment and Discipline for the United States Patent and
Trademark Office ("USPTO" or "Office") filed a disciplinary complaint
against Mr. Greiner alleging that he violated the USPTO Code of Professional
Responsibility by misappropriating client funds, abandoning clients and
neglecting patent matters they had entrusted to him, and submitting a check
to the Office that was returned because it had been drawn on an account with
insufficient funds. Mr. Greiner did not answer the complaint, and, on
October 18, 2012, the administrative law judge ("ALJ") assigned to case
granted the OED Director's motion for default judgment and entered an Initial
Decision on Default excluding Mr. Greiner. Because Mr. Greiner did not appeal
the ALJ's initial decision, the decision became final. Mr. Greiner's
exclusion from the practice of patent, trademark, and other non-patent law
before the United States Patent and Trademark Office began on November 17,
2012.

   The ALJ concluded, inter alia,  that Mr. Greiner violated: (i) 37 C.F.R.
§§ 10.23(a) (proscribing disreputable or gross misconduct), 10.23(b)(4)
(proscribing dishonesty, fraud, deceit, or misrepresentation), and
10.23(c)(3) (proscribing misappropriating or failing to properly or timely
remit, funds received from a client to pay a fee required to be paid to
Office) by having requested, received and retained client funds for fees and
expenses in connection with a patent application without later forwarding
the funds to Office to pay the fees or having incurred expenses; (ii)
37 C.F.R. §§ 10.23(a) and 10.23(b) via § 10.23(c)(8) for failing to inform
his clients of correspondence received from the Office when the
correspondence could have a significant effect on a pending matter, was
received on behalf of a client, and was correspondence of which a reasonable
practitioner would believe under the circumstances the client should be
notified; (iii) 37 C.F.R. § 10.77(c) (proscribing neglect) by failing to
respond to certain clients' numerous attempts to communicate with him, not
advising certain clients that their applications had been abandoned, and
neglecting certain clients' patent applications; (iv) 37 C.F.R. § 10.84
(proscribing intentionally prejudicing or damaging a client during the course
of a professional relationship) by misappropriating client funds, failing to
respond to Office correspondence, allowing patent applications to become
abandoned, failing to take steps for issuance of a patent, and abandoning
clients; and (v) 37 C.F.R. § 10.23(b)(4) by submitting a check to the Office
that had been drawn on insufficient funds and was dishonored, after
Respondent had been previously been disciplined for issuing a check that was
dishonored. Accordingly, the ALJ determined that exclusion was the
appropriate sanction.

   This action is taken pursuant to 35 U.S.C. §§ 2(b)(2)(D) and 32 and 37
C.F.R. §§ 11.20, 11.32, 11.36(e), 11.54(a), 11.55(i), and 11.59. Disciplinary
decisions regarding registered practitioners are posted at the Office of
Enrollment and Discipline's Reading Room, which is publicly accessible via
www.uspto.gov.

New Maintenance Fee Payment by E-Mail Pilot Program
              New Maintenance Fee Payment by E-Mail Pilot Program

   Effective Date: Effective upon publication of this notice.

   The United States Patent and Trademark Office (Office) is conducting a
pilot program for the electronic submission and processing of multiple
maintenance fee payments delivered to the Office in a single submission.
Maintenance fee payments under the pilot program will be submitted by e-mail
with e-mail attachments that meet particular format requirements. Only
maintenance fee payments made using a deposit account as set forth in 37 CFR
1.25 will be accepted under this new maintenance fee payment pilot program.

   Until now, the only way to pay patent maintenance fees electronically was
the on-line maintenance fee payment system found at the "Office of Finance
On-Line Shopping Page" of the Office's Web site (www.uspto.gov). Users of
the on-line maintenance fee payment system can pay one maintenance fee at a
time using a deposit account, credit card or electronic funds transfer (EFT).
The Office is currently developing an on-line maintenance fee payment system
that will improve upon the current system in two respects. First, the future
on-line maintenance fee payment system will be able to accept multiple
maintenance fee payments (i.e., bulk payments) in a single transaction.
Second, the future on-line payment system will be able to accept
certifications changing entity status (e.g., from large entity to small
entity) to enable maintenance fee payments to be paid in the amount
corresponding to the changed entity status. The current on-line maintenance
fee payment system will only accept payments in the amount corresponding to
the entity status of record at the time of payment.

   The planned future on-line maintenance fee payment system would require
the bulk maintenance fee submitter to send a text file in a particular
format identifying the patents to be maintained in force. Because the pilot
program is intended to test the concept of the future on-line maintenance
fee payment system, the same kind of text file planned for the future on-line
maintenance fee payment system will be required under the new pilot program.
Maintenance fee payments made under the new pilot program, however, will be
submitted via e-mail rather than on-line via the Internet. Even though the
new pilot program should be particularly useful to firms and companies that
routinely make bulk maintenance fee payments at the USPTO, the  e-mail pilot
program is available to all maintenance fee submitters having deposit
accounts with the USPTO.

   The maintenance fee payment by e-mail pilot program is the only exception
to the prohibition against paying patent fees by e-mail. However, maintenance
fee payments by e-mail will also not be accepted by the Office even during
the duration of the pilot program unless the e-mail is sent to
MFbulkpayment@uspto.gov and contains an attachment meeting the requirements
set forth on the following webpage of the USPTO Web site:
http://www.uspto.gov/about/offices/cfo/finance/bulkinstructions_pilotprogram.
pdf.  No maintenance fee payment will be accepted via e-mail unless the
instructions contained on that webpage are followed.

   This pilot program will run for at least six months from its effective
date. The Office may extend, terminate, revise or otherwise take appropriate
action after evaluating its effectiveness at the end of that period.

ACTION: Request for Comments.

SUMMARY: The United States Patent and Trademark Office (Office)
currently has a backlog of over 90,000 patent applications that have
not been examined since the filing of a Request for Continued
Examination (RCE). This backlog diverts resources away from the
examination of new applications. The Office is continuing its efforts
to reduce the RCE backlog. For example, the Office recently implemented
a pair of pilot programs - the Quick Path Information Disclosure
Statement (QPIDS) pilot program and the After Final Consideration Pilot
(AFCP) - designed to reduce the need to file an RCE. The Office is now
soliciting public feedback in an effort to better understand the full
spectrum of factors that impact the decision to file an RCE. The Office
is providing three different avenues for the public to provide their
feedback on RCE practice: (1) Through the submission of written
comments by electronic mail message over the Internet or by postal
mail; (2) through the submission of written comments using a Web-based
collaboration tool called IdeaScale[supreg]; and (3) through a series
of roundtables that the Office is planning to conduct. The Office plans
to use the information it obtains to design additional programs and
initiatives aimed at reducing RCE filings and the RCE backlog.

before February 4, 2013.

facilitates an understanding of filing strategies related to RCEs.

    (1) If within your practice you file a higher or lower number of
RCEs for certain clients or areas of technology as compared to others,
what factor(s) can you identify for the difference in filings?
    (2) What change(s), if any, in Office procedure(s) or regulation(s)
would reduce your need to file RCEs?
    (3) What effect(s), if any, does the Office's interview practice
have on your decision to file an RCE?
    (4) If, on average, interviews with examiners lead you to file
fewer RCEs, at what point during prosecution do interviews most
regularly produce this effect?
    (5) What actions could be taken by either the Office or applicants
to reduce the need to file evidence (not including an IDS) after a
final rejection?
    (6) When considering how to respond to a final rejection, what
factor(s) cause you to favor the filing of an RCE?
    (7) When considering how to respond to a final rejection, what
factor(s) cause you to favor the filing of an amendment after final (37
CFR 1.116)?
    (8) Was your after final practice impacted by the Office's change
to the order of examination of RCEs in November 2009? If so, how?
    (9) How does client preference drive your decision to file an RCE
or other response after final?
    (10) What strategy/strategies do you employ to avoid RCEs?
    (11) Do you have other reasons for filing an RCE that you would
like to share?

    Interested members of the public can provide the Office with their
feedback on RCE practice through the submission of written comments by
electronic mail message over the Internet or by postal mail sent to the
corresponding address noted above. Feedback on RCE practice can
alternatively be submitted using a Web-based collaboration tool called
IdeaScale[supreg]. The tool allows users to post comments on a topic,
and view and respond to others' comments. In addition, users may vote
to indicate agreement or disagreement with a particular comment.

             Public Use in Patent and Trademark Resource Centers

The following libraries, designated as Patent and Trademark Resource Centers
(PTRCs), provide public access to patent and trademark information received
from the United States Patent and Trademark Office (USPTO). This
information includes all issued patents, all registered trademarks, the
Official Gazette of the U.S. Patent and Trademark Office, search tools such
as the Cassis CD-ROM suite of products and supplemental information in a
variety of formats including online, optical disc, microfilm and paper.
Each PTRC also offers access to USPTO resources on the Internet and to
PubWEST (Web based examiner search tool), a system used by patent examiners
that is not available on the Internet.

Staff assistance and training is provided in the use of this information.
All information is available free of charge. However, there may be charges
associated with the use of photocopying and related services. Hours of
service to the public vary, and anyone contemplating use of these
collections at a particular library is urged to contact that library in
advance about its services and hours to avoid inconvenience.
